These general terms and conditions (hereinafter “GTC”) apply to all services offered by Expat-Expo GmbH (hereinafter “Expat Expo”). By using our services, you accept the following conditions unchanged and in full.

I. Subject

  • 1.1 General
    The subject of these T&Cs is the use of services that Expat Expo provides to ticket buyers via the following sales channels: www.expat-expo.com
    The use of personal data is regulated in the privacy policy. The privacy policy is an integral and binding part of these terms and conditions.
  • 1.2 Ticketing
    Expat Expo operates an event management business. Ticket buyers (hereinafter “ticket buyers”) can reserve or purchase tickets for events (hereinafter “event”) and tickets for admission to any number of Expat Expo live event s each year.
  • 1.3 User account
    • 1.3.1
      Customers can create an Expat Expo user account by registering. Customers can use the user account, regardless of whether they have purchased a ticket or not, to manage newsletters and alerts for upcoming events, change personal data, and view orders that have been placed. By sending the corresponding confirmation email after completing registration, a user agreement with Expat Expo regarding the user account is concluded. The access data provided during registration, in particular the password, must be kept safe. The password must not be passed on to third parties. If a customer becomes aware of misuse of their access data, they must inform Expat Expo immediately.
    • 1.3.2
      The customer can terminate the user agreement by notifying Expat Expo. Termination of the user agreement means that the customer no longer has access to the data stored in the user account. Expat Expo recommends not terminating the user agreement as long as the customer still needs the user account for ongoing event tickets, contracts or claims. Expat Expo accepts no responsibility if a customer is unable to use services due to termination. In the event of termination by the customer, Expat Expo reserves the right to keep the user account active until all claims between the customer and Expat Expo have been met. Expat Expo is entitled to block the user account and terminate the user agreement at any time, in particular if the user account is being misused for fraudulent or other illegal purposes or by unauthorized third parties or if there is a suspicion of such misuse.

II. Ticket distribution services

  • 2.1 Services
    • 2.1.1
      Expat Expo’s terms and conditions, which are accessible via the sales channels, apply to all services. Expat Expo may change the range of services offered or stop providing services at any time.
    • 2.1.2
      By ordering tickets, the ticket buyer instructs Expat Expo to process the ticket purchase, including shipping. By purchasing the ticket, a contract for attending the event or business is concluded exclusively between the ticket buyer and the event organizer or operator, on the basis of these terms and conditions and the terms and conditions of the organizer or operator.

      When using services and products from Expat Expo’s partner companies, the ticket buyer accepts the applicable general terms and conditions and/or terms of use of these partner companies.
  • 2.2 Conclusion of contract
    • 2.2.1 Ticket buyer’s order
      The overview of the accessible tickets provided by the sales channels is only an invitation to the ticket buyer to make an offer. The ticket buyer makes their selection via the corresponding sales channel. The selection made is displayed in the shopping cart (web shop) or communicated to the ticket buyer (telephone order and advance booking office). By confirming the order, the ticket buyer submits their binding offer to purchase the selected tickets. The ticket buyer is obliged to provide all information required during the ordering process completely and correctly.
    • 2.2.2 Registration
      The ticket buyer must register to place an order via the web shop (hereinafter “online order”) (see section 1.3). The data required for registration must be truthful and complete. The ticket buyer is obliged to keep this data up to date and to ensure that he can be contacted at the address provided. In the event of untrue or incomplete information, Expat Expo reserves the right to cancel orders without consultation and to charge the ticket buyer a handling fee.
      To place an online order, the ticket buyer must identify themselves in the web shop with their user name or email address and password (hereinafter “access data”; the corresponding user account is the “online account”).
      The access data provided to the ticket buyer is intended for the personal use of the ticket buyer and must be treated confidentially. All online orders placed via the online account are attributed to the ticket buyer as the online account holder and are binding for him.
    • 2.2.3 Order confirmation
      When ordering via the web shop, or when the customer provides their email address via an order hotline, the ticket buyer will receive an order confirmation by email after completing the order process. This does not constitute acceptance of the offer by Expat Expo.
    • 2.2.4 Acceptance by Expat Expo
      The contract for the reservation or purchase of a ticket for attending the event or business between the ticket buyer and the organizer or operator only comes into effect when the tickets are sent, made available or handed over to the ticket buyer or when Expat Expo activates the access authorization on a ticket card. The dispatch, making available, handing over or activation only takes place after the buyer’s payment has been received by Expat Expo or the advance purchase point, regardless of the type of payment.
    • 2.2.5 Personalized tickets
      The organizer or operator is entitled to personalize tickets. To do this, the personal details of the authorized person can be printed on the ticket or linked electronically. Only the person named on the ticket or linked electronically will be granted access to the booked event or business. If a buyer books tickets for several people, he or she must ensure that the personal details of all persons are complete and truthful.
  • 2.3 Delivery of tickets
    • 2.3.1 General
      • 2.3.1.1
        The decision regarding the choice of delivery method rests with the organizer or operator. The delivery or dispatch of the ticket can be made in paper form to the postal address provided by the ticket buyer, by email with a download link to the PDF file of the print at home ticket (both barcode and QR code; hereinafter referred to as “print at home ticket”), as a mobile ticket by SMS to the specified mobile phone number (hereinafter referred to as “mobile ticket”) or if set up by Expat Expo in the future, a mobile application, by activating a ticket card (Section 2.10) or in paper form by handing it over at the box office (hereinafter referred to collectively as “tickets”).
      • 2.3.1.2
        The ticket buyer is obliged to check the tickets immediately after receipt. In the case of personalized tickets, the ticket seller is particularly obliged to check whether the personalized information is correctly reproduced. The ticket buyer must notify Expat Expo within 3 working days of any damage to the tickets or any deviations between the tickets delivered by post or electronically and the tickets ordered. If the ticket buyer fails to do so, the delivered tickets are deemed to have been approved (Art. 201 OR).
      • 2.3.1.3
        Benefit and risk are transferred to the ticket buyer at the time of dispatch from Expat Expo’s headquarters (Art. 74 Para. 2 No. 2 OR). The ticket buyer is responsible for keeping the tickets safe until the event. Replacement of damaged or lost tickets is excluded, subject to No. 2.3.2.3, 2.3.3.2 and 2.10.3.
    • 2.3.2 Electronic delivery of print at home tickets
      • 2.3.2.1
        The print at home ticket, which is accessible after receipt of payment via the link provided with the order confirmation, is printed by the ticket buyer in the same size using a suitable printer on white A4 paper. The ticket buyer acknowledges that it is his own responsibility and risk to have all the necessary technical equipment required to receive and print the print at home ticket.
      • 2.3.2.2
        The printed print at home ticket must be carefully stored until the event is attended and must not show any damage, dirt or other impairments when used, particularly in the area of ​​the machine-readable bar or QR code, which would make entry control impossible or hinder it. If the print at home ticket shows such damage, dirt or other impairments, there is no entitlement to admission to the event and/or to reimbursement of the fee paid by the ticket buyer.
      • 2.3.2.3
        For each ticket purchased, the ticket buyer only receives one access authorization. Any duplication, copying, modification or imitation of the print at home ticket and any electronic distribution of the corresponding PDF file is expressly prohibited. However, if the print at home ticket is lost or damaged, the ticket buyer may reprint the print at home ticket, although he is aware of the possibility of being denied access to the event if the circumstances in section 2.3.2.4 apply. The damaged print at home ticket must be destroyed immediately. If the ticket buyer has already deleted the PDF file at the time of loss or damage, he can reprint the ticket in his online account or contact the Expat Expo hotline. Expat Expo will then resend the PDF file to the ticket buyer. Expat Expo reserves the right to limit the number of re-deliveries. The ticket buyer is aware that it is not possible to block the print at home ticket. In this case, the provisions of section 2.3.2.4 also apply.
      • 2.3.2.4
        The organizer can refuse entry to the event if there are several printouts, reproductions, copies or imitations of a print at home ticket in circulation and a holder of a printout, copy or imitation of the respective print at home ticket has already been granted entry to the event. In particular, the organizer is not obliged to check the identity of the ticket holder with the ticket buyer or to check the authenticity of the print at home ticket. If a holder of a print at home ticket is turned away during access control for this reason, there is no entitlement to a refund of the fee.
    • 2.3.3 Electronic delivery of mobile tickets
      • 2.3.3.1
        In the case of mobile tickets, delivery takes place after payment has been made by sending a message to the mobile number provided by the ticket buyer. The mobile ticket is displayed in the message in the form of a link or an image, depending on the model of the mobile device.
      • 2.3.3.2
        The ticket buyer acknowledges that it is his own responsibility and risk to have all the technical equipment required to receive or make the mobile ticket available. If access to the ticket is lost or the mobile device is damaged, the ticket buyer can request the mobile ticket again within the online account or have it delivered to him. Expat Expo reserves the right to limit the number of redeliveries. If the number of permitted deliveries has been used up, the ticket buyer must contact the Expat Expo hotline.
      • 2.3.3.3
        Access to the event or facility cannot be granted without presenting the Mobile Ticket.
  • 2.4 No resale
    Any trading of purchased tickets for business or commercial purposes is prohibited. The purchase of tickets for the purpose of business or commercial trading is also prohibited. Violations can lead to the loss of the service associated with the purchased tickets and to claims for damages and profits against the original ticket buyer and the ticket purchasers. Persons who violate these provisions can be excluded from purchasing and returning tickets. In the event of reasonable suspicion, Expat Expo reserves the right to cancel the orders in question and to charge the original ticket buyer a handling fee. Neither Expat Expo nor the organizer or operator accept liability for tickets sold via other platforms. Tickets that are not validly purchased do not entitle the holder to enter the event or the establishment, and neither Expat Expo nor the organizer or operator accept any refund or liability claims in this regard.
  • 2.5 Advertising and raffles
    Without the express prior consent of the organizer or operator, the ticket buyer is not permitted to use tickets, member packages and/or member tickets in advertising aimed at the general public and/or for raffles.
  • 2.6 Prices
    • 2.6.1
      Where there is a price for entry, prices for event tickets accessible via the sales channels or indicated or communicated therein include VAT (where applicable).
    • 2.6.2
      The sales price displayed in the web shop include the ticket price of the organizer or operator plus any service fee, excluding any payment and shipping fees. The sales price at the advance booking offices includes the ticket price of the organizer excluding order fees from the point of sale (POS). The fees applicable for the respective sales channel, with regard to the respective delivery method and/or payment method are displayed in the shopping cart during the ordering process or communicated to the ticket buyer.
  • 2.7 Payment
    • 2.7.1 Purchase/reservation at advance booking offices
      When purchasing or reserving tickets at advance booking offices or at the company headquarters directly, the respective partner company as the operator of the advance booking office determines the permitted payment methods.
  • 2.8 Returns, refunds, re-registrations and exchanges
    • 2.8.1 General
      The responsible contractual partner of the ticket buyer for the implementation of the visit to the event or business arranged by Expat Expo or the provision of the service associated with the ticket is the respective organizer or operator (in most cases, Expat Expo). The possibility, conditions and processing of a return and refund or exchange of purchased/reserved tickets for events or a business are therefore decided solely by the organizer or operator, in most cases Expat Expo. This sole decision-making authority of the organizer or operator also applies in the event of force majeure (see Section IX below).
    • 2.8.2 Transferring personalized tickets to another person
      The organizer or operator alone decides whether and under what conditions personalized tickets can be transferred to another person. If transferring is permitted, only the original purchaser can have the tickets transferred.
    • 2.8.3 Cancellation of an event or closure of a business
      If an event is cancelled without replacement (this also includes the cancellation or postponement of part of a series of events or individual performances) or if a business is closed in whole or in part, meaning that no more ticket buyers can be received, the tickets will be refunded at the instruction of the organiser or operator in accordance with section 2.8.6.
      A cancellation of an event or the closure of a business occurs regardless of the duration of the closure and the specific reason for the closure or cancellation of the event.
    • 2.8.4 Special features when postponing an event or the venue
      If an organizer decides to postpone an event or to relocate a venue, the ticket is valid for the postponement date or the new venue, regardless of the reasons for the postponement. This also applies if the event is postponed or relocated several times. It is at the discretion of the organizer (Expat Expo) to decide whether tickets can be returned, refunded or exchanged, if money has been exchanged. Any change to the date and/or location of the event is considered a postponement, regardless of whether the event is held on the new date with the same content, the same companies/exhibitors, or teams, or with characteristics and criteria that differ from the original event.
    • 2.8.6 Processing of returns and refunds
      • 2.8.6.1
        If money has been exchanged for a visitor ticket, and the organizer or operator agrees to the return and refund of tickets and the processing in accordance with this section 2.8.6, this will be done in accordance with the following provisions. Otherwise, the ticket buyer must contact the organizer or operator directly.
      • 2.8.6.2
        If money has been exchanged for a visitor ticket, Expat Expo will issue refunds at the organizer’s instruction, usually within 30 days of the event date printed on the ticket. The current ticket holder is entitled to a refund. Ticket holders who ordered their tickets directly online or by telephone through money has been exchanged for a visitor ticket must enter the barcodes of the tickets in question in the refund form provided by Expat Expo. Ticket holders who did not purchase their tickets directly through Expat Expo are encouraged to contact Expat Expo. Expat Expo will provide them with an alternative link to the refund. Completing the refund form and the information entered therein is the sole responsibility of the ticket buyer; Expat Expo assumes no liability whatsoever. The physical tickets do not have to be sent to Expat Expo. Important: The physical tickets must be kept until the ticket price is refunded. Expat Expo is entitled to request that the physical tickets be sent in at any time. After receipt of the ticket price, physical tickets must be destroyed. By refunding the ticket price, the ticket buyer or any subsequent ticket purchaser waives any claims against Expat Expo. Tickets purchased through a Expat Expo ticket office must in all cases be submitted to the relevant ticket office in physical form for refund. Expat Expo or the ticket offices will only refund the ticket price if they have sufficient coverage from the organizer to refund all tickets for the canceled event. Service, payment and shipping fees paid by the ticket buyer as well as any other processing fees and insurance fees for ticket sales will not be refunded. After 30 days from the event date printed on the ticket or if Expat Expo or the ticket offices do not have sufficient coverage from the organizer to refund all tickets for the canceled event, ticket buyers must contact the organizer directly. The organizer will then determine how the return and refund of the tickets will be processed.
      • 2.8.6.3
        If the organizer agrees to return and refund the tickets and the event has been postponed or cancelled, the ticket buyer may be charged an expense allowance for the sale and refund of the tickets in the amount of CHF 5 or 10% of the gross ticket price.
      • 2.8.6.4
        If payment is made by credit card, TWINT or PostFinance, Expat Expo will generally credit the corresponding amount within four weeks to the card or account used to purchase the ticket or to the bank or postal account specified by the ticket holder in the event of a refund. If payment is made in advance, the amount will be credited to the bank or postal account specified by the ticket holder. Expat Expo requires the following information for this: bank/postal details (name, location), bank clearing number, IBAN, account number and account holder (name, first name).
  • 2.9 Obligations of the ticket buyer when visiting the event or establishment
    • 2.9.1
      By purchasing a ticket or using the services of the organizer or operator, the ticket buyer accepts the general terms and conditions, privacy policy, terms of use or contractual conditions of the organizer or operator in addition to these terms and conditions. These are available from the respective organizer or operator.
    • 2.9.2
      By purchasing the ticket, the ticket buyer acknowledges the safety, access, age and other implementation regulations of the respective event organizer or operator as well as any requirements for entry provided by the authorities. The ticket buyer is responsible for complying with these regulations and acknowledges that failure to comply with these regulations may result in him being excluded from the event or operation without compensation. In this case, there is no right to return the tickets. The applicable regulations are available from the respective event organizer or operator.
    • 2.9.3
      If tickets have been issued personalized, only the person named on the ticket will be admitted to the event or the establishment. Security personnel are authorized to check this on site. To do so, the ticket holder must be able to identify themselves using a personal ID. If the name on the ticket does not match the name on the ID or the name on the ticket is illegible, admission may be refused without replacement and without entitlement to financial reimbursement.

III. Additional services provided by organizers and operators

  • 3.1 Services
    The specific additional services provided by the organizers and operators can be seen on the respective websites and mobile applications.
  • 3.2 Conclusion of contract
    Expat Expo may sometimes enable the direct conclusion of a contract between a third-party organizer or operator and the user for other services such as reservations. The direct conclusion of a contract for these services is exclusively between the organizer or operator and the user on the basis of these T&Cs and the terms and conditions of the organizer or operator. By using the services of the organizer or operator, the user accepts the general terms and conditions, terms of use or contractual conditions of the organizer or operator in addition to these T&Cs. These are available from the respective organizer or operator.
    The option of making a reservation or registering for a waiting list is merely an invitation to the user to make an offer. By confirming the reservation or registering for a waiting list, the user submits a binding offer to the organizer or operator.

IV. Responsibilities of the ticket buyer and the user

  • The ticket buyer and the user have the following responsibilities:
    • The ticket buyer as well as the user are responsible for the internet connection required to use Expat Expo’s services.
    • If the ticket buyer and the user use a mobile version of the website, they are responsible for using the most up-to-date version of the mobile version.
    • The ticket buyer as well as the user are responsible for complying with current safety regulations.
    • Access data and passwords must be kept secret. The ticket buyer and the user are responsible for any use of the access data and passwords and all actions that are carried out in connection with the use of the online account and the user account. Should an unauthorized third party actually or potentially gain access to the access data including passwords of the online account and the user account, the ticket buyer and the user are obliged to inform Expat Expo immediately.
    • The ticket buyer as well as the user may only use Expat Expo’s services within the legally permissible framework.
    • The ticket buyer as well as the user must refrain from any actions that impair or may impair the operation of the web shops or sales process.

V. Rights of Expat Expo

  • If the ticket buyer/reserver and/or the user violates these Terms and Conditions, Expat Expo has the right to temporarily or permanently block the affected services and/or access to the online account and/or user account and to demand compensation for the inconvenience.

VI. Warranty

  • 6.1
    Expat Expo will provide its services carefully and professionally within the scope of its operational resources and foreseeable requirements, unless Expat Expo is prevented from doing so by circumstances beyond its control.
  • 6.2
    The ticket buyer and the user are aware that Expat Expo provides its services via the Internet or using communication networks. In particular, technical faults, operational disruptions, disruptions or interruptions to communication networks and failures of IT infrastructures, the lines of the order hotline or other parts of the infrastructure used to provide the service may result in temporary impairments or interruptions to the provision of services by Expat Expo. Expat Expo therefore provides no guarantee for the uninterrupted availability, functionality and freedom from errors of its services.

VII. Liability

  • 7.1 Liability of Expat Expo
    • 7.1.1
      In the event of breaches of its own contractual obligations under these Terms and Conditions, Expat Expo shall be liable to the ticket purchaser and/or the user without limitation for direct and proven damages caused by Expat Expo through unlawful intent or gross negligence.
    • 7.1.2
      Liability is expressly excluded for slight negligence and for indirect or consequential damage. Consequential damage includes in particular lost profits, damage to reputation and loss of data as a result of temporary impairments or interruptions in the availability of Expat Expo’s services and as a result of a failure of sales channels. Consequential damage also includes in particular lost profits, damage to reputation and loss of data as a result of transmission errors, late delivery of tickets, reservations or registrations for waiting lists as well as as a result of incorrect price or service information and errors in booking confirmations. Also excluded is any liability of Expat Expo for content on websites of event organizers or operators as well as other third parties that refer to Expat Expo’s web shops and websites or to which Expat Expo’s web shops and websites refer. To the extent permitted by law, any liability of Expat Expo for vicarious agents is excluded.
    • 7.1.3
      Expat Expo cannot check the completeness, accuracy and legality of the tickets and services of any third-party organizer or operator distributed by Expat Expo in the name and on behalf of the organizer or operator and is not responsible for this.
    • 7.1.5
      Expat Expo cannot check whether any third-party organizer or operator is correctly and completely fulfilling its performance obligations arising from or in connection with the contract between it and the respective ticket buyer. Likewise, Expat Expo cannot check whether the organizer or operator is correctly and completely fulfilling its performance obligations arising from or in connection with the contract between it and the respective user. The organizer or operator or the ticket buyer are solely liable for breaches of contract, such as in particular inadequate organization of the operation or implementation of the event, cancellation of events in breach of contract, closure of the operation in breach of contract, poor quality of services and breach of the ticket buyer’s obligations when attending the event or operation, but under no circumstances Expat Expo. This exclusion of liability also applies to quasi-contractual and non-contractual claims arising from the execution of the contract, in particular the use of organizer or operator services between the ticket buyer and the organizer or operator. This exclusion of liability also applies to quasi-contractual and non-contractual claims arising from the execution of the contract between the organizer or operator and the user.
    • 7.1.6
      The above exclusions and limitations of Expat Expo’s liability do not apply in the event of culpable injury to life, body or health caused directly by Expat Expo.
  • 7.2 Liability of the ticket buyer
    • 7.2.1
      The ticket buyer is liable to Expat Expo without limitation for damages caused by unlawful intent or negligence. The ticket buyer fully indemnifies Expat Expo against all claims by third parties that may arise from a breach of duty by the ticket buyer or a violation of these terms and conditions.
    • 7.2.2
      The ticket buyer is obliged to reimburse Expat Expo for any expenses incurred in connection with the unauthorized use or misuse of the ticket buyer’s/reserver’s password. The ticket buyer of a print at home ticket is also obliged to reimburse the organizer or operator and Expat Expo for any damage incurred in connection with the unauthorized use of additional or modified printouts, reproductions, copies or imitations.
  • 7.3 Liability of the user
    The user is liable to Expat Expo without limitation for damages caused by unlawful intent or negligence. The user fully indemnifies Expat Expo against all claims by third parties that arise from the use of Expat Expo’s services or that may arise from the user violating these terms and conditions.

VIII. Force majeure

  • If the event or operation is cancelled or postponed by the organiser or concluded by the operator due to a disease crisis (e.g. epidemic or pandemic, regardless of the number of waves of spread that have already occurred) or similar force majeure (i.e. an external event that cannot be foreseen and cannot be averted or cannot be averted in time even by applying reasonable care and technically and economically reasonable means, such as natural disasters, terrorist attacks, failure of telecommunications connections, strikes, official or non-official measures, etc.), the contract between the ticket buyer and the organiser or operator remains valid. In this case, the organiser or operator decides on the further procedure in accordance with section 2.8 above.

IX. Intellectual Property

  • The web shops, websites, any future mobile applications and all of Expat Expo’s content accessible via the web shops, websites, online or paper-based (hereinafter “content”) are protected by copyright and, unless otherwise specified, belong exclusively and entirely to Expat Expo. The web shops, any future mobile applications and websites may contain references to third-party protection and usage rights, which must be observed by both the ticket buyer and the user. The (complete or partial) reproduction, distribution, transmission (electronically or by other means), modification, linking or use of the content for public or commercial purposes is prohibited without the prior written consent of Expat Expo.
    In any case, the ticket buyer and the user are prohibited from using the web shops, mobile applications or websites to develop other services or from modifying, translating, reproducing or decompiling the source code or examining its functions, unless this is legally required.

X. Final provisions

  • 10.1
    The place of performance for Expat Expo services, including the delivery of tickets, is Expat Expo’s registered head office.
  • 10.2
    The ticket buyer waives the right to offset any claims against Expat Expo.
  • 10.3
    Expat Expo reserves the right to change these Terms and Conditions at any time. Changes will be made available on the websites or any future mobile applications and will take effect when they are posted.
  • 10.4
    Should one or more provisions of these Terms and Conditions be or become invalid or unenforceable in whole or in part, the validity or enforceability of the remaining provisions of these Terms and Conditions or the purchase of the ticket and/or other services shall not be affected. In this case, the parties shall replace the invalid or unenforceable provision with a valid and enforceable provision that comes closest to the economic purpose of the provision to be replaced. The same applies mutatis mutandis in the event that these Terms and Conditions contain a regulatory gap.

    These Terms and Conditions and any disputes arising from or in connection with the relationship between Expat Expo and the ticket buyer as well as the relationship between Expat Expo and the user shall be governed exclusively by Swiss law, excluding the provisions of the conflict of laws and the provisions of the UN Convention on Contracts for the International Sale of Goods (CISG).

    The exclusive place of jurisdiction for all disputes between Expat Expo and the ticket buyer and between Expat Expo and the user is the registered office of Expat Expo. However, Expat Expo is entitled to take legal action against the ticket buyer and the user at their place of residence.
